What is product liability?
Under product liability law, the seller of a defective product is responsible for any injury that results to a buyer, user, or even an innocent bystander. Defendants in product liability cases may include manufacturers, distributors and retailers. The laws governing product liability vary in Washington, D.C., and West Virginia, but typically, three types of cases may be pursued:
- Manufacturing defects. Manufacturing defects generally result from some mistake in the manufacturing process, improper workmanship, or the use of defective materials.
- Design defects. Design defects occur when a product includes a design feature or element that is faulty and unreasonably dangerous.
- Duty to warn. A manufacturer also has a duty to warn consumers of unsafe or dangerous features of its products.
You may also be able to pursue a product liability claim if the product you used was advertised in a way that is not suitable for its intended use. These types of cases usually involve medication or medical products, such as using a particular type of birth control as a way to control acne.
Why choose Paulson & Nace?
Our experienced team of trial attorneys regularly represents clients who have sustained serious and even life-altering injuries because of a defective product. In one case, we represented a client who was paralyzed in a car accident because of a defective seatbelt. We use state-of-the-art technology when presenting cases in court, and spare no expense when it comes to building and presenting a case. Late partner Barry Nace once litigated a case over the course of 18 years because he refused to accept less than what was best for his client, and because we always see our cases through to the end. We put the full force of our firm behind every single case we take on, because we know that sometimes terrible things happen to good people – and those people deserve a chance at a happy and healthy life after an accident.
